Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your access to and use of the PingCore platform, website, APIs, and related services (collectively, the "Service") operated by ThinkHuge Ltd. ("Company", "we", "us", or "our"), a company registered in Hong Kong with its registered office at 26th Floor, Beautiful Group Tower, 77 Connaught Road Central, Central, Hong Kong.
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
3. Account Registration
To use certain features of the Service, you may need to register an account or submit a registration of interest. You agree to provide accurate, current, and complete information and to keep this information up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
You must notify us immediately at [email protected] if you become aware of any unauthorized use of your account.
4. Service Description
PingCore provides a game server infrastructure platform that enables users to deploy, manage, and scale game servers using container orchestration technology. The Service includes but is not limited to:
- Game server provisioning and management via web dashboard and REST API
- Container orchestration on Kubernetes infrastructure
- Global multi-region deployment
- Content delivery network (CDN) for game files
- DDoS protection
- Team management and role-based access control
- API key management and audit logging
- White-label panel capabilities for hosting providers
- Pre-configured game templates ("Cores")
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Host, distribute, or facilitate the distribution of malware, botnets, or other malicious software
- Engage in cryptocurrency mining or similar resource-intensive activities unrelated to game server hosting
- Launch or facilitate denial-of-service attacks against any target
- Host content that is unlawful, defamatory, or infringes intellectual property rights
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Resell or redistribute the Service except through authorized white-label or hosting provider arrangements
- Circumvent any usage limits, billing mechanisms, or security measures
We reserve the right to suspend or terminate your access to the Service immediately and without notice if we determine, in our sole discretion, that you have violated these acceptable use provisions.
6. Pricing and Payment
The Service is billed on a pay-as-you-go basis. Resources (CPU, memory, disk, and ports) are billed hourly based on actual usage. Current pricing details are available on our Pricing page.
We offer two billing models:
- Prepaid Credit: You top up your account balance via Stripe. Resources are deducted hourly from your balance. Low balance warnings are provided.
- Invoiced (Arrears): Usage is tracked and invoiced after the billing period. Available for qualified accounts.
All fees are exclusive of applicable taxes. We reserve the right to change pricing with 30 days' notice. Continued use after a pricing change constitutes acceptance of the new pricing. Overdue invoices may result in suspension of the Service.
7. Service Level
We target 99.9% platform availability for our infrastructure. This excludes scheduled maintenance windows, force majeure events, and issues caused by third-party providers or your own configurations.
DDoS protection is included on all game servers at no additional cost. While we employ gaming-specific mitigation techniques, no protection system can guarantee complete mitigation of all attacks.
8. Data and Content
You retain all ownership rights to your data, game server configurations, and content uploaded to the Service ("Your Content"). By using the Service, you grant us a limited license to host, store, transmit, and process Your Content solely for the purpose of providing the Service.
You are solely responsible for Your Content and for ensuring that it does not violate any applicable laws or third-party rights. We do not monitor Your Content but reserve the right to remove content that violates these Terms.
9. API Usage
Access to the PingCore API is subject to these Terms. API keys are confidential and must not be shared publicly. We reserve the right to impose rate limits and usage quotas. Abuse of the API, including excessive requests intended to degrade the Service, may result in throttling or suspension of access.
10. Intellectual Property
The Service, including its software, design, documentation, and branding, is the property of ThinkHuge Ltd. and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
Pre-configured game Cores provided through the Service are licensed for use within the platform only. Game names and trademarks referenced within Cores belong to their respective owners.
11. Third-Party Services
The Service integrates with third-party services including payment processors (Stripe), security providers (Cloudflare), and game distribution platforms (Steam). Your use of these third-party services is subject to their respective terms and conditions. We are not responsible for the availability or performance of third-party services.
12. Limitation of Liability
To the maximum extent permitted by applicable law, ThinkHuge Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless ThinkHuge Ltd., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, with or without notice.
Upon termination, your right to use the Service ceases immediately. We will make commercially reasonable efforts to allow you to retrieve Your Content for 30 days following termination, after which it may be deleted. Any outstanding fees remain payable.
15. Modifications to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
